1. ORGANISER AND PURPOSE OF THE PROMOTION
S.A. DAMM, with registered premises at c/ Rosselló, 515, holder of Tax ID No. A08000820, is organising a promotion called ”ELECTRIC SCOOTER VOLL-DAMM" (hereinafter, the PROMOTION), with the aim of publicising products marketed under the "VOLL-DAMM" brand, owned and registered by S.A. DAMM, and encouraging consumption of these products. This promotion will be subject to the following Legal Terms and Conditions.
2. GEOGRAPHICAL SCOPE OF THE PROMOTION AND ELIGIBLE PARTICIPANTS
The PROMOTION is aimed at end consumers who purchase a 18 cans or 18 bottle of Voll-Damm beer and meet the requirements set out in these Terms and Conditions.
Only persons over 18 years of age resident in Spain may take part in the PROMOTION.
Any person working for S.A.DAMM and/or its distributors, family members of such persons, and any other person directly or indirectly related to the creation and implementation of the PROMOTION is expressly excluded from this PROMOTION.
Participants who fail to meet any of these requirements will be automatically disqualified, even if they submit winning entries.
3. DURATION OF THE PROMOTION
The PROMOTION will start on 1 April 2021 and will end on 30 April 2021, both included.
Participations after the end date mentioned above will not be accepted.
4. MECHANISM OF THE PROMOTION AND GIFTS
If a user who complies with the promotional mechanism and the other requirements outlined in these Legal Terms and Conditions purchases a 18 cans or 18 bottles of Voll-Damm beer at a store, and this purchase is shown on a single receipt within the established promotional period, they will be able to get 1 of the 40 Xiaomi MI Electric Scooter 1, valued at 370.00.- (THREE HUNDRED SEVENTY) euros each.
The mechanism to qualify for the prizes of this promotion for winning moments is the following:
In order to participate, the user must visit the promotional website www.dammt.com, where they must register as a new user in the login section and where they will fill in the following information: name, surname, password, email, country, province and zip code. Once correctly registered, , the user must visit the promotional website www.patientevolldamm.com, where they should enter their personal details (email, full name), attach a copy of the receipt where the purchase can be clearly seen in accordance with these terms and conditions, and accept these terms and conditions.
The photo receipt must have the purchase date and the price detail of the product that is the object of this promotion must be visible. Only one entry is valid for each purchase ticket. If the description of the brand (Voll Damm beer) does not appear on the purchase receipt, an image of the product must be attached along with the purchase receipt.
5. WINNING MOMENTS
After entering their personal data and the receipt photo, the user will enter the draw for the prizes detailed in point 4, through the Winning Moment system.
The Winning Moments will be delimited by a computer program, previously to the start of the promotion and completely randomly, and 40 "Winning Moments" will be chosen by the server, consisting of 30 days, hours, minutes and seconds within all possible of the promotional period. Each Winning Moment will be associated with one of the 40 raffled prizes that will be deposited together with these Terms and Conditions lodged with Mr. Jose-Alberto Marín Sánchez, Notary of the Official College of Barcelona, at Carrer Diputació, 268 (entresol),.
During the the promotion, established in point 3, each participation will be registered on the promotion server in a specific month, day, hour, minute and second, so the computer program will automatically check if the participation has coincided with any of the "Winning Moments", lodged with Mr. Jose-Alberto Marín Sánchez, Notary of the Official College of Barcelona.
In the event that there is no participation coinciding with any of the Winning Moments, the winner will be the user who completes the registration of personal data immediately after the Winning Moment, and who meets the aforementioned requirements. In the event that there are no users in moments after the winner, this will be the previous participant closest to the selected time and so on until the winner is determined.
The "moment of participation of a consumer" will be the moment in which he fills in the participation form on the website www.patinetevolldamm.com, uploads the purchase ticket that meets the requirements of the promotional mechanics and clicks on the button of "Participate."
The winners will be contacted through the email provided to consult the email address to which to send the prize.
S.A. DAMM reserves the right to request the original receipt uploaded at the time of registration. If the receipt has been tampered with, is a photocopy, has been lost, or has been used to participate in other promotions that S.A. DAMM may organise at the same time as this promotion, or fails to meet any of the requirements specified in these Terms and Conditions, the user will not be entitled to receive a refund for the money spent on buying Votl-Damm beer.
The period to validate the ticket once the participant is awarded will be 72 hours.

6. RESPONSIBILITIES
S.A. DAMM is not responsible for incidents or events of any kind caused by malfunctions of the computer program due to force majeure (e.g., a user's inability to register, interruption or loss of a call, etc.) or incidents of force majeure arising from causes such as breakdowns in telephone, computer and electricity networks, due to natural factors such as atmospheric or climate conditions, or failure to provide these services by the companies operating them.
S.A. DAMM is not responsible if it is impossible for a user to register because of an error in the capture of their personal data, as a result of any documents that are illegible, incomplete, erroneous or false.

S.A. DAMM may also declare this PROMOTION invalid if it detects irregularities in users' identification data.

10. APPLICABLE LAW AND JURISDICTION
